SyncFu is about bringing the bargaining power of the masses to the table to get you a better deal. As such we wanted some terms and conditions that could be understood by the masses. The merchants have a different set of terms and conditions that they have to sign up to when they decide to offer a deal through SyncFu but this bit is about how we will work with you. It deals with what we will and won't do and with what you can and cannot do with what we are offering you
Before we start on the terms and conditions it is worth making clear who we will deal with. If you are a minor or are not able to enter into a fully binding legal agreement for any other reason then we are not willing to provide a service for you. If you are using this site then you are implicitly saying that you are competent to make agreements of all kinds. That is a condition of use of the site.
The first thing to cover is what we are going to charge you, what you get for it and why you cannot have it back.
SyncFu is doing a couple of things for you. The first is that we are letting you use our software. The second is we are using our software to arrange deals for you.
Once you have joined a deal and the deal has reaches its target goal of minimum participants, you will not get your money back as we have charged you and forward the merchant who offered the deal the majority of the payment.
Why can't you have it back? Well two reasons really:
As soon as you have entered your credit card/paypal details, we grant you the right to use the software and to join the deal. When you enter your payment details you grant us with the right to charge you once the deal has reach its minimum of participant.
If we allowed you your money back there would be no incentive not to sign up for a deal in case you might turn out to be interested. We only want you to sign up for a deal if you mean to go through with that deal. Imagine a case where to get an amazing deal you need 100 people. Now imagine that 90 of them pulled out at the last moment because they were never really interested in the first place. You would not get your deal and would be pretty annoyed. We want you to only commit to a deal if you really mean it so we want an incentive for you to stick the course.
It is important to remember any deal you have, is with the merchant. If you have an issue with a merchant then we would like to be told about it. We may even (at our discretion) make some suggestions about dealing with it, but we cannot be held responsible for either end of the deal. We are not selling you anything. We give you the right to use our software to talk to a merchant about a deal. We are involved in helping the merchant to offer their deal but they are the ones offering it.
We do, in the terms and conditions for the merchant set certain requirements for the merchant but we cannot be responsible for enforcing them. At our discretion we do reserve the right to refuse merchants the right to use our software but we cannot commit to monitoring any particular deal, let alone to looking at all of them and trying to manage some sort of enforcement role. We are software providers and to a very limited extent in a very few cases administrative aids to those who are setting up deals.
We have two levels of merchant accounts, those who have registered in an automated fashion and those whom we consider to be 'trusted' merchants. In neither case can we be responsible for the behavior of what is really a different company but in the latter case we can at least tell you the criteria that they have fulfilled and the processes they have gone throughout. These are detailed here. These procedures are updated to try to minimize issues so a company who has signed on before a change was made to the conditions or procedures may not have been required to fulfill any particular procedure. That said if we are still dealing with a company after a rules change then it suggests (but does not guarantee) that they have been behaving well enough.
It is worth mentioning a couple of things here:
We are not in partnership with the merchants.
We are not acting as agents on behalf of any of the merchants.
The same two things are true for of our Buyers. We are not in partnership with our Buyers, nor are we acting as agents for them.
We will be passing your details on to the merchants you are doing deals with. If you fail to get the price you want then we may pass your details on to someone with another similar offer later.
We do not in any way guarantee the merchandise or service of the merchants. We do guarantee our service will work. We do not guarantee that the deal you sign up for will happen as we have no control over who and/or how many people sign up for it. In many cases there are deals which only require one person (you in that case) to sign up. There we cannot guarantee the merchant side of the deal.
If someone pretends to be us in order to get your details (phishing) or attempts any other sort of scam we do disapprove but we cannot be held responsible.
We reserve the right at our sole discretion to deny service to or ban in any way we choose any Buyers or potential Buyers for any reason or even for no reason at all. We have no intention of being unreasonable about this but we need this clause in here to cover any unforeseen eventualities. If we knew what they would be we could give you examples but then they would not be unforeseen.

Our rules about items that are not allowed or are only allowed under certain conditions are often based on country and state laws, including copyright or trademark laws. In some cases, we don't allow selling certain items because of health or safety reasons, or if they're controversial or sensitive in nature but aren't necessarily against the law. We may also prohibit certain items based on input from our members, government agencies, and the community.
The use of the SyncFu software, platform, branding, name and website are not allowed, or are only allowed in a restricted way for, to be associated with, or used in the marketing or sale of any of the following.
Anything which is illegal to sell or requires special licenses for the sale of within the UK, the USA or Ireland.
Human body parts.
Items which are unsafe or dangerous.
Live animals.
Adult Only category
alcohol (see also wine)
animals and wildlife products - examples include live animals, mounted specimens, and ivory
artifacts, grave-related items, and Native American arts and crafts
contracts
counterfeit currency and stamps
credit cards
currency, selling
drugs and drug paraphernalia
drugs, describing drugs or drug-like substances
embargoed goods and prohibited countries - examples include items from Cuba
firearms, weapons, and knives - examples include pepper spray, replicas, and stun guns (see also military items)
government documents, IDs, and licenses
government, transit, and shipping-related items - examples include airplane operations manuals, subway employee uniforms, and U.S. Postal Service (USPS) mailbags
hazardous materials - examples include batteries, fireworks, and Freon
human parts and remains
importation of goods into specific countries - examples include CDs that were intended only for distribution in a certain country
items encouraging illegal activity - examples include an eBook describing how to create methamphetamine
lottery tickets
mailing lists and personal information
military items (see also firearms, weapons, and knives)
multi-level marketing, pyramid, and matrix programs
offensive material - examples include ethnically or racially offensive material and Nazi memorabilia
pesticides
police-related items
political memorabilia (reproduction)
postage meters
prescription drugs
prohibited services
recalled items
slot machines
stocks and other securities
stolen property and property with removed serial numbers
tobacco
The absence of an item from this list does not mean SyncFu will necessarily allow it; the list is simply those items which, without a written exception from SyncFu, are not allowed on the site.
All merchants are required to follow local law at all times.
All merchants are required to provide a clear, honest, and accurate description about the item that is the subject of the deal.
All merchants are required to avoid tactics like keyword spamming because they make it hard for people to find what they're looking for.
At all times the liability of SyncFu, regardless of cause, is limited to the amount paid by the merchant to SyncFu. As some services are supplied free they are supplied for use at the user's own risk and with no guarantees express or implied.
Merchants are required to honor an offered price provided that the following two conditions have been met:
The group size for that price has been reached at some point.
At least 90% of the group members are prepared to buy at that price.
To allow for the people that decide not to become Buyer it is suggested that group thresholds be set include a 10% margin in terms of the number of people required for a given price. Under any and all conditions SyncFu's liability is limited to the amount paid to SyncFu by the merchant.
"On the rare occasion that on a closed deal some of the buyers drop their payment you will be obligated to honor all other buyers at the discounted price"
SyncFu reserve the right to deny use of any and all properties and/or services at their absolute discretion without incurring any liability by so doing. SyncFu may without discussion ban, either temporarily or permanently, any merchant at any time with no notice, prior or otherwise.
Getting paid We are using paypal as our primary payment service,
once a buyer joins a deal, he enter his payment details and agrees to
be charged once the deal is on.
Once the deal reaches its
minimum of participants, we will charge automatically all deal
participants and forward you, the merchant your payment (immediately)
less our agreed commission.
All payments will be made to your
paypal account as entered by you upon sign up.
